Allow reversion ('Rudd')

When the estate is undersubscribed after named heirs get their shares, the remainder is divided among the named heirs. Imam Malik did not allow this, but his students did under certain conditions.

Allow reversion to spouses

The majority opinion does not include spouses in reversion. However, Uthman includes them, and Egyptian law includes spouses in reversion if they are the sole heirs.

Bequest to Non-Heirs

Specify a bequest to non-heirs as a fraction of the estate (e.g., 1/4). Cannot exceed 1/3 or leave blank.

Islamic Rule: Bequests to non-heirs cannot exceed 1/3 of the total estate.

Note: This amount will be deducted from the total estate before calculating inheritance shares for the heirs.

What are Non-Heirs?

Non-heirs are individuals who are not entitled to inherit under Islamic law but may receive a bequest (wasiyyah). This includes:

Friends and close companions
Charitable organizations
Non-Muslim relatives
Adopted children (who are not biological heirs)
Servants or employees

Islamic Rules for Bequests:

Maximum Limit: Cannot exceed 1/3 of the total estate
Priority: Debts and funeral expenses are paid first
Heir Consent: Bequests to heirs require consent from other heirs
Voluntary: Bequests are optional, not mandatory

Note: The remaining 2/3 (or more) of the estate must be distributed among the rightful heirs according to Islamic inheritance shares.
